Agreement to Terms

These Terms and Conditions (the “Terms”) are a legally binding agreement between you and Rocco Group OÜ (registry code 11286471), doing business as Sizehim (“Sizehim”, “we”, “us”, or “our”), governing your access to and use of the Sizehim website and any related services (collectively, the “Site”). By accessing or using the Site, you confirm that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. Please review the Terms regularly.

The Site is intended for users who are at least 18 years old. By using the Site, you represent that you are 18 or older. The Site is offered from Estonia and may not be appropriate or available in other jurisdictions. You are responsible for compliance with local laws where you access the Site.

Intellectual Property

Unless otherwise indicated, the Site, its content, features, and functionality—including text, graphics, logos, images, audio, video, software, and the Sizehim name and logos (collectively, the “Content”)—are owned by or licensed to us and are protected by intellectual property laws. The Content is provided on an “as-is” basis for your personal, non-commercial use only. Except as expressly permitted in these Terms, you may not copy, reproduce, modify, publish, distribute, sell, license, or otherwise exploit any Content without our prior written consent.

We grant you a limited, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. All rights not expressly granted are reserved by Sizehim.

Accounts and Security

You may need an account to use certain features. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any suspected unauthorized use of your account.

Services, Subscriptions, and Payments

The Site offers a one-time hand scan and subscription-based access to certain features. Prices and available offerings may change at any time. Payments are processed securely by Stripe. The payment methods available to you are those supported by Stripe at checkout. The currency and final price are shown at checkout and may include taxes where applicable.

Subscriptions renew automatically at the end of each billing cycle unless you cancel. You can cancel at any time, and your access will continue until the end of the current paid period. We may offer a self-service billing portal to manage your subscription and payment details.

All sales are final and non-refundable, including one-time scans and subscription charges, except where a refund is required by applicable law. This does not affect any mandatory consumer rights you may have under the laws of your country of residence.

Acceptable Use

You agree not to misuse the Site. Prohibited conduct includes: accessing the Site using automated means; attempting to interfere with security or integrity; reverse engineering the software; scraping or harvesting data; uploading viruses or malicious code; infringing the rights of others; or using the Site for unlawful, harmful, or abusive purposes.

User Content and Feedback

If you submit suggestions, ideas, or feedback, you grant us a worldwide, royalty-free, transferable, sublicensable, and irrevocable license to use, reproduce, modify, and publish such feedback for any purpose without compensation to you. You retain ownership of any content you submit that is not feedback, subject to the rights you grant to us and compliance with these Terms and applicable law.

The Site may contain links to third‑party websites or resources. We do not control and are not responsible for their content, policies, or practices. Your use of third‑party sites is at your own risk and subject to their terms and policies.

Privacy

We care about data privacy and security. Please review our Privacy Policy (available on the Site). By using the Site, you acknowledge that your personal data will be processed in accordance with our Privacy Policy.

Sizehim provides informational content based on hand measurements and does not provide medical or health advice. The Site is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified professional with any questions you may have.

Disclaimers

The Site and Content are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Site will be uninterrupted, secure, or error‑free, or that any content will be accurate or complete.

Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Site. Our total liability for any claim relating to the Site shall not exceed the amount you paid to us for the applicable service during the twelve (12) months prior to the event giving rise to the claim, or, if no such payments were made, one hundred (100) euros.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia. If you are a consumer in the EU, you may benefit from mandatory provisions of the law of your country of residence. Any dispute that cannot be resolved informally within thirty (30) days may be finally resolved by arbitration in accordance with the rules of the European Court of Arbitration. The seat of arbitration shall be Berlin, Germany, and the language shall be English. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

Modifications and Availability

We may modify, suspend, or discontinue all or part of the Site at any time without notice. We are not liable for any unavailability, delays, or errors. We may also remove or change content without notice.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Site and supersede all prior understandings. If any provision is found unenforceable, the remaining provisions will remain in full force. We may assign these Terms. No waiver is effective unless in writing. Headings are for convenience only.
